What the lawsuit claims
On August 15, 2025, Justin Brewer filed a proposed class action against Otter.ai in federal court in Northern California, as NPR reported. He was not an Otter user. The complaint alleges that Otter's meeting assistant joined a call he was on, recorded the conversation without asking every participant for consent, and that Otter used meeting recordings to train its speech-recognition models. Otter.ai asked the court to dismiss the case. Related suits were later combined into one case.
The complaint cites federal and state wiretap and privacy laws. In its August 13, 2026 order, the court allowed claims under the federal Wiretap Act (ECPA), the California Invasion of Privacy Act and Illinois's biometric privacy law to proceed, and dismissed the Computer Fraud and Abuse Act claims with leave to amend. Meeting notetakers that join calls are useful for meetings. If your work is with public video (lectures, interviews, tutorials, podcasts posted online), a link-based tool like ClawGrab avoids the question entirely: nobody on a call gets recorded, because there is no call.
